Nietzsche, the Godfather of Fascism? What can Nietzsche have in common with this murderous ideology? Frequently described as the "radical aristocrat" of the spirit, Nietzsche abhorred mass culture and strove to cultivate an Übermensch endowed with exceptional mental qualities. What can such a thinker have in common with the fascistic manipulation of the masses for chauvinistic goals that crushed the autonomy of the individual? The question that lies at the heart of this collection is how Nietzsche came to acquire the (...) deadly "honor" of being considered the philosopher of the Third Reich and whether such claims had any justification. Does it make any sense to hold him in some way responsible for the horrors of Auschwitz? The editors present a range of views that attempt to do justice to the ambiguity and richness of Nietzsche's thought. First-rate contributions by a variety of distinguished philosophers and historians explore in depth Nietzsche's attitudes toward Jews, Judaism, Christianity, anti-Semitism, and National Socialism. They interrogate Nietzsche's writings for fascist and anti-Semitic proclivities and consider how they were read by fascists who claimed Nietzsche as their intellectual godfather. This paper outlines an Husserlian, phenomenological account of the first stages of the acquisition of empirical knowledge in light of some aspects of Wilfrid Sellars’ critique of the myth of the given. The account offered accords with Sellars’ in the view that epistemic status is attributed to empirical episodes holistically and within a broader normative context, but disagrees that such holism and normativity are accomplished only within the linguistic and conceptual confines of the space of reasons, and rejects the limitation (...) of the relevant normativity to the cognitive domain. Attention to the phenomenological notion of motivations in our mapping of the structure and acquisition of empirical knowledge reveals a form of weak categoriality given in experience, one outside exclusive mediation by language and concepts but also not merely causal. Section 1 outlines some basic aspects of Sellars’ account of empirical knowledge in Empiricism and the Philosophy of Mind, including a regress objection that arises due to his claim that empirical knowledge presupposes knowledge of general facts about perception. Section 2 examines Sellars’ later revisiting of the objection, via his critique of Roderick Firth, in “The Lever of Archimedes,” focusing on his analysis of the “Myth of the Categorial Given” and his use of the notion of ur-concepts. Section 3 looks at Sellars’ psychological nominalism and his rejection of the explanatory primacy of experience in light of the strict dichotomy between the space of causes and the space of reasons, and shows how Firth’s account aligns with phenomenology in its advocating for an irreducible and non-inferential role for experience. It also raises an important objection to Sellars’ account concerning the categorial givenness of causality. Section 4 turns to Husserl, arguing that his conception of motivation in the Logical Investigations and Ideas II reveals a third explanatory or logical space “between” that of causes and that of reasons. Section 5 further develops this account with regard to the explanatory role of lived experience. Section 6 revisits the regress objection to Sellars from the phenomenological standpoint developed earlier in the paper, and argues that an Husserlian account of empirical knowledge offers a viable alternative to Sellars’ that overcomes the regress objection and gives proper explanatory weight to the evidence of lived experience vis-à-vis scientific presuppositions about causality. This edited volume examines the realizations between theological considerations and natural law theorizing, from Plato to Spinoza.Theological considerations have long had a pronounced role in Catholic natural law theories, but have not been as thoroughly examined from a wider perspective. The contributors to this volume take a more inclusive view of the relation between conceptions of natural law and theistic claims and principles. They do not jointly defend one particular thematic claim, but articulate diverse ways in which natural law has (...) both been understood and related to theistic claims.In addition to exploring Plato and the Stoics, the volume also looks at medieval Jewish thought, the thought of Aquinas, Scotus, and Ockham, and the ways in which Spinoza's thought includes resonances of earlier views and intimations of later developments. Taken as a whole, these essays enlarge the scope of the discussion of natural law through study of how the naturalness of natural law has often been related to theses about the divine. The latter are often crucial elements of natural law theorizing, having an integral role in accounting for the metaethical status and ethical bindingness of natural law. At the same time, the question of the relation between natural law and God-and the relation between natural law and divine command-has been addressed in a multiplicity of ways by key figures throughout the history of natural law theorizing, and these essays accord them the explanatory significance they deserve. This article discusses the process of empirical research on access to justice, explaining the procedure from data collection to analysis. Research into access to justice finds ways to render civil justice to citizens equitably. Reliable, non-anecdotal data is a prerequisite for useful empirical research into access to justice. Three international initiatives illustrate the reflection of access to justice in research projects. They are, the World Bank's Justice for the Poor Program, UNDP Commission on Legal Empowerment of the Poor, and the (...) Tilburg Microjustice Initiative. The most comprehensive empirical projects on access to justice are those sponsored at the national or sub-national level. Non-governmental drivers of broad-based data collection are other legal actors. This article discusses examples of data collection and evaluation in countries where research has generated data on civil justice. Finally, this article discusses barriers to access to justice, which cause exclusion. (shrink)

This paper argues that the approach to questions of authority, legitimacy, and personal identity characteristic of contemporary European law presents a paradox. The power of the legal project that emerged after the French Revolution lay in its deployment of the notion of abstract legal subjectivity to challenge claimed authority. Much is made of the public law dimensions of this revolutionary moment—the creation of political constitutions establishing national citizenship and human rights standards. But the transposition of abstract legal subjectivity into the (...) private law through national social constitutions like Civil Codes has been far less successful.legal subjectivity in public law regimes necessarily privileges some personal identities over others in its construction of citizenship. These privileged identities of public law citizenship limit how legal subjects can express their identities in the private law. The paper proposes an alternative, pluralist, theorization of the diverse, iterative character of everyday human interaction that gives content to the idea of legal subjectivity in the private law. It seeks to reconcile a public law of abstract, unitary citizenship with a private law of plural legal subjectivities in a manner that advances the project of democratic constitutionalism. (shrink)

In student-led movements, women, minorities, immigrants, and indigenous people demanded that universities adapt to better serve the increasingly heterogeneous public and student bodies. The success of these movements had a profound impact on the intellectual landscape of the twentieth century: out of these efforts were born ethnic studies, women’s studies, (...) and American studies. In _We Demand,_ Roderick A. Ferguson demonstrates that less than fifty years since this pivotal shift in the academy, the university is moving away from “the people” in all their diversity. Today the university is refortifying its commitment to the defense of the status quo off campus and the regulation of students, faculty, and staff on campus. The progressive forms of knowledge that the student-led movements demanded and helped to produce are being attacked on every front. Not only is this a reactionary move against the social advances since the ’60s and ’70s—it is part of the larger threat of anti-intellectualism in the United States. (shrink)

This article uses the circumstances of black intimacies within the nineteenth century to analyze the ways in which the law, by definition, limits human possibility and agency. This limiting of possibility and agency is then visited upon LGBT people in the moment of marriage equality. The article attempts to show how that limiting is, in fact, part of the definition of legal personhood. While expanding forms of agency prescribed by the state, the law has also worked to narrow the forms (...) of social agency produced and enacted by minoritized communities. This article, in sum, takes the marriage right as an example of a legal agency that confers personhood and narrows the intimate universes and social capacities produced by racial and sexual minorities. Chris L. Firestone and Nathan Jacobs integrate and interpret the work of leading Kant scholars to come to a new and deeper understanding of Kant's difficult book, Religion within the Boundaries of Mere Reason. In this text, Kant's vocabulary and language are especially tortured and convoluted. Readers have often lost sight of the thinker's deep ties to Christianity and questioned the viability of the work as serious philosophy of religion. Firestone and Jacobs provide strong and cogent grounds for (...) taking Kant's religion seriously and defend him against the charges of incoherence. In their reading, Christian essentials are incorporated into the confines of reason, and they argue that Kant establishes a rational religious faith in accord with religious conviction as it is elaborated in his mature philosophy. For readers at all levels, this book articulates a way to ground religion and theology in a fully fledged defense of Religion which is linked to the larger corpus of Kant's philosophical enterprise. In this essay, I examine Philip Clayton’s efforts to construct a philosophical theology that fits the current scientific view of organism. Clayton capitalizes on an evolutionary outlook, which sees organism as an emergent entity composed of lower organic unities, and which, at the highest level of organic development (brain), yields an emergent, non-physical phenomenon (mind). Presuming a bilateral relationship between mind and body, Clayton argues for a picture of God-world relations where world is analogous to body and God is analogous (...) to emergent mind. Contrary to Clayton, I argue that panentheism does not naturally accommodate the current scientific picture of organic development, and as an alternative, I submit St. Augustine of Hippo’s theistic modifications to Plotinian NeoPlatonism. My goal is to demonstrate that Augustine’s metaphysic offers a strong foundation for the construction of a theologically robust and scientifically satisfying philosophy of organism. (shrink)

Are there key respects in which character and character defects are voluntary? Can agents with serious vices be rational agents? Jonathan Jacobs answers in the affirmative. Moral character is shaped through voluntary habits, including the ways we habituate ourselves, Jacobs believes. Just as individuals can voluntarily lead unhappy lives without making unhappiness an end, so can they degrade their ethical characters through voluntary action that does not have establishment of vice as its end. Choosing Character presents an account (...) of ethical disability, expanding the domain of responsibility and explicating the role of character in ethical cognition. Jacobs contends that agents become ethically disabled voluntarily when their habits impair their ability to properly appreciate ethical considerations. Such agents are rational, responsible individuals who are yet incapable of virtuous action. The view develops and modifies Aristotelian claims concerning the fixity of character. Jacobs' interpretation is developed in contrast to the overlooked work of Maimonides, who also used Aristotelian resources but argued for the possibility of character change. Wigner's quantum-mechanical classification of particle-types in terms of irreducible representations of the Poincaré group has a classical analogue, which we extend in this paper. We study the compactness properties of the resulting phase spaces at fixed energy, and show that in order for a classical massless particle to be physically sensible, its phase space must feature a classical-particle counterpart of electromagnetic gauge invariance. By examining the connection between massless and massive particles in the massless limit, we also derive a classical-particle (...) version of the Higgs mechanism. (shrink)

Drawing on the empirical premise that attention makes objects look more intense, Ned Block has argued for mental paint, a phenomenal residue that cannot be reduced to what is perceived or represented. If sound, Block's argument would undermine direct realism and representationism, two widely held views about the nature of conscious perception. We argue that Block's argument fails because the empirical premise it is based upon is false. Attending to an object alters its salience, but not its perceived intensity. We (...) also argue that salience should be equated with mental primer, a close cousin of mental paint that reintroduces difficulties for direct realism and representationism. We address a long-standing debate over whether classical magnetic forces can do work, ultimately answering the question in the affirmative. In detail, we couple a classical particle with intrinsic spin and elementary dipole moments to the electromagnetic field, derive the appropriate generalization of the Lorentz force law, show that the particle's dipole moments must be collinear with its spin axis, and argue that the magnetic field does mechanical work on the particle's elementary magnetic dipole moment. As consistency checks, we calculate (...) the overall system's energy-momentum and angular momentum, and show that their local conservation equations lead to the same force law and therefore the same conclusions about magnetic forces and work. Any realist interpretation of quantum theory must grapple with the measurement problem and the status of state-vector collapse. In a no-collapse approach, measurement is typically modeled as a dynamical process involving decoherence. We describe how the minimal modal interpretation closes a gap in this dynamical description, leading to a complete and consistent resolution to the measurement problem and an effective form of state collapse. Our interpretation also provides insight into the indivisible nature of measurement—the fact that you can't stop a (...) measurement part-way through and uncover the underlying 'ontic' dynamics of the system in question. Having discussed the hidden dynamics of a system's ontic state during measurement, we turn to more general forms of open-system dynamics and explore the extent to which the details of the underlying ontic behavior of a system can be described. We construct a space of ontic trajectories and describe obstructions to defining a probability measure on this space. (shrink)

Matteo Ricci (1552-1610) was an Italian Jesuit and one of the first Christian missionaries to China in the modern era. He was a genuine polymath—a translator, cartographer, mathematician, astronomer, and musician. Above all, Ricci was a missionary for the gospel. As we briefly examine his 1603 seminal work, The True Meaning of the Lord of Heaven, our hope is that we, as evangelical educators, will perceive some of the deeper principles necessary for our own missionary work among unreached people.

As conceptual and theoretical discussions on environmental valuation approaches have advanced there is growing interest in the impact that valuation has on decision making. The perceived legitimacy of the outputs of valuation studies is seen as one factor influencing their impact on policy decisions. One element of this is ensuring that participants of valuation processes see the results as legitimate and would be willing to accept decisions based on these findings. Here, we test the perceived legitimacy to participants of two (...) approaches to deliberative monetary valuation, deliberated preferences and Deliberative Democratic Monetary Valuation, in the context of marine planning in the Clyde estuary in Scotland. We compare and contrast deliberated preference and deliberative democratic monetary valuation and track their emergence as responses to critiques of conventional stated preference approaches. We then present the results of our case study where we found that deliberative democratic monetary valuation produced valuations that were perceived as more legitimate that deliberated preference as the basis for decision making by those involved in the valuation process. Market metaphors have come to dominate discourse on medical practice. In this essay, we revisit Peter Berger and colleagues’ analysis of modernization in their book The Homeless Mind and place that analysis in conversation with Max Weber’s 1917 lecture “Science as a Vocation” to argue that the rise of market metaphors betokens the carry-over to medical practice of various features from the institutions of technological production and bureaucratic administration. We refer to this carry-over as the product presumption. The product presumption (...) foregrounds accidental features of medicine while hiding its essential features. It thereby confounds the public understanding of medicine and impedes the professional achievement of the excellences most central to medical practice. In demonstrating this pattern, we focus on a recent article, “Physicians, Not Conscripts—Conscientious Objection in Health Care,” in which Ronit Stahl and Ezekiel Emanuel decry conscientious refusals by medical practitioners. We demonstrate that Stahl and Emanuel’s argument depends on the product presumption, ignoring and undermining central features of good medicine. We conclude by encouraging conscientious resistance to the product presumption and the language it engenders. (shrink)

Although early-stage finance is critical to the growth of most ventures, it is even more important for social ventures as they face the challenges of balancing their social and commercial objectives. Drawing on institutional logics and signaling theory, this study uses a panel data set of 3,401 nascent social ventures to investigate the important role philanthropic grant funding plays in the organizational and financial development of social ventures. We find mixed results, with positive effects on employment and subsequent access to (...) debt finance, but no effects on revenues and access to equity. Our findings connect these theories by suggesting philanthropic grants provide social ventures with flexibility to invest in human capital without pushing them to pursue short-term financial objectives, and that receiving a philanthropic grant provides a signal that is interpreted differently by debt and equity financiers. These findings are especially relevant as funders increasingly use grants to support social entrepreneurship. (shrink)

This paper offers a psychobiographical study of the connection between the life and work of Heije Faber , the internationally best known Dutch psychologist of religion. Initially, Faber studied theology, qualifying in philosophy of religion; in later years, he studied psychology . As a politically active pastor, he had to hide from the Nazi-occupation of The Netherlands during World War II. In 1970 he became the first professor of the psychology of religion at a Dutch theological faculty. Faber was interested (...) in a psychoanalytic approach to religion, by the end of his life particularly in selfpsychology as developed by Heinz Kohut. There is a curious contradiction in his work: although Faber employs several types of psychology in his autobiography to interpret aspects of his own development, he neglects the Kohutian psychology that he had himself helped to introduce to The Netherlands. This article tries to solve the paradox and suggests some psychological hypotheses as to the relationship of Faber psychodynamics and his contribution to psychology. (shrink)

How should we incorporate algorithms into humanistic scholarship? The typical approach is to clone what humans have done but faster, extrapolating expert insights to landfills of source material. But creative scholars do not clone tradition; instead, they produce readings that challenge closely held understandings. We theorize and then illustrate how to construct bad robots trained to surprise and provoke. These robots aren’t the most human but rather the most alien—not tame but dangerous. We explore the relationship between the reproduction of (...) tradition and the generation of surprise and then show how formalizing a particular humanistic theory as a Bayesian prior allows us to identify readings that disrupt it through a process of algorithmic abduction. Among the exploding universe of surprising (and mostly ridiculous) possible readings, algorithmic efficiency allows us to select readings that nonetheless garner substantial support from the total archive and so merit interpretation and engagement. It is in such interaction between alien and human readers that meaning is made and understanding disturbed; it is by extending alien readings to novel texts that the scholarly community tests the value of those readings. This article, based on extensive empirical research and occasioned by the centennial of both the present journal Archiv für Religionspsychologie and its owner, the International Association for the Psychology of Religion, deals extensively with the activities in the psychology of religion of Wilhelm Stählin, the prime force behind the IAPR and founding editor of the AfRp. The article discusses Stählins profound methodological contributions to the literature. It analyses the rather informal “founding” of the IAPR on June 10, 1914 and describes (...) its aims and first activities. Sadly, what had started so promising was destroyed by World War I: the most active members of the board were drafted into the army and had no time left at all for any activities in the field of the psychology of religion. As a consequence of the economic misery in Germany after the war, there was even no paper available to print a next volume of the AfRp until 1921. In the preface to that volume, Stählin articulated his inability to say anything about a possible future of both AfRp and IAPR. Paradoxically, the beginning had become an end, and should only in 1928 be followed by a new start. (shrink)

This article deals with the contributions to the psychology of religion made by Dr. Marianne Beth , an almost totally forgotten pioneer of the psychology of religion. The article especially contextualizes her initiative to turn “unbelief” into a topic for research in psychology of religion, and describes the tragic end the Nazi reign made to her development and career. Born as the daughter of a prominent Austrian Jewish lawyer living in Vienna, Marianne von Weisl received excellent intellectual training. Initially, her (...) wish to become active in the same field as her father was frustrated by the injunction against women studying law. When this injunction was lifted, she went for a second doctorate in law, her first doctorate having been in the humanities. Marianne Beth became very active in public life ; she travelled and gave lectures and developed a large radius as a prolific author in newspapers and periodicals. Although clearly committed women’s rights, she did not belong to any feminist movement.Her interest in psychology was certainly stimulated by her husband Karl Beth , a professor of systematic theology, who developed an increasing interest in both history and the psychology of religion. In fact, psychology of religion seems to have become the field in which the couple collaborated intellectually most. They were both involved in the founding of a “research institute” for the psychology of religion, of an international society for the psychology of religion, and of a journal for the psychology of religion. All these activities took place from the apartment of the Beths in Vienna, where the preparations for the First International Congress for the Psychology of Religion also occurred. That congress had as its theme; “the psychic causes of unbelief”. Even earlier than her husband, Marianne Beth had published on the topic of unbelief. Her interest may have been triggered by a call for papers by the internationally renowned Kant-Society. The Society issued a prize for a treatise on “the psychology of belief” in 1928, which Marianne Beth then won. It is also possible, however, that the call for papers had been triggered after her initial publications on the subject. Her paper was published in the well-known journal Kant-Studien.There was a plan to publish the contributions to the 1931 congress in Vienna in book form in a series of three volumes, but only one was published, probably due to financial problems. The rest of the papers presented were published in the Zeitschrift für Religionspsychologie, edited by the Beths. As her publications since then show, she grew increasingly interested in empirical topics and approaches, and was broadly read in contemporary psychology. She authored numerous contributions to the Zeitschrift für Religionspsychologie. However, when Nazi-Germany annexed Austria in 1938, she left the country for the United States, taking both her children with her. Shortly afterwards, Karl Beth was also obliged to follow his family into exile. In the US, neither had any opportunity to pursue their interests in the psychology of religion; Marianne taught sociology briefly and German; Karl taught “comparative theology”.Nevertheless, Marianne Beth’s impulse to turn “unbelief” into a research topic in the psychology of religion did have some lasting influence: the work of better-known psychologists of religion such as Rümke, Pruyser and Vergote are indebted to her, at least indirectly, as this article tries to show. Criticizing some psychological approaches that speak in too general terms about both music and religion, this article turns to a precise empirical observation and asks what psychology might possibly contribute to its understanding, after first necessarily questioning what terms such as ‘religion’, ‘religious music’, ‘religious experience’ encompass. Given the nature of the leading question, a cultural–psychological approach is chosen. After refuting a number of commonly heard assertions, and drawing on a number of psychological theories, the article then discusses several empirical (...) observations and argues that contemporary psychology has indeed achieved some progress in dealing with classical questions. We suggest that the hierarchical predictive processing account detailed by Clark can be usefully integrated with narrative psychology by situating personal narratives at the top of an individual's knowledge hierarchy. Narrative representations function as high-level generative models that direct our attention and structure our expectations about unfolding events. Implications for integrating scientific and humanistic views of human experience are discussed.
